A foundation is a tailored hybrid between a trust and a company. There are many similarities, but the key difference to a trust is that a foundation is a separate legal entity in its own right, whereas a trust functions through its trustee.
Many jurisdictions, including Jersey, The Bahamas and Panama have enacted specific foundations legislation.
The foundation, run by a nominated council, holds assets in its own name to fulfil the purpose stated in its charter and regulations.
